HCJ 2732/05 - Head of Azzun City Council et al. v. Government of Israel et al. Judgment

The HCJ accepts HaMoked's petition regarding the route of the separation wall in the area of the villages Azzun and Nabi Ilyas. The route in this area stole hundreds of acres of agricultural land belonging to residents of the villages. The state previously admitted that the wall does not run adjacent to the settlement Tzufin due to the settlement's outline plan, and that had the route of the wall been planned today, the outline plan would not have been taken into consideration. The HCJ accepts the petition, but suspends an announcement regarding the invalidity of the route for six months from the day the wall is completed in a new route. The HCJ orders the state to pay 50,000 NIS in trial fees.
