HCJ 1336/16, 1337/16,1721/16, 1777/16 - Atrash et al. v. GOC Home-Front Command Judgment

Judgment on four petitions submitted by HaMoked against the state's intention to seal the family homes in Zur Baher of four suspects in a stone throwing incident in Jerusalem in September 2015, which resulted in the death of Alexander Levlovich. The judges accepts the petitions on the matter of the three suspected of involvement in the stone throwing, and rejects, by a majority of two, the petition regarding the suspect of stone throwing. The Court rules, regarding the three, that due to their relatively small role in the event, sealing their home would be disproportionate. Justice Vogelman emphasizes, in a minority opinion, that the man suspected of throwing stones is not accused of "an intention to kill", and he therefore believes the state should consider sealing his room only, rather than sealing or demolishing the entire house.
