Dear friends,

From Gaza to Jerusalem, this past month has been full of worrying developments. Palestinians' rights in the city are under threat, both on the declarative level with the move of the U.S. Embassy and with concrete measures on the ground. So I am glad to have some good news to report.

As you may know, Israel makes it exceedingly difficult for Palestinians to live in Jerusalem with their families. Whereas family unification is a basic right, Israel places all sorts of restrictions on who can receive a permit to live with their spouse in Jerusalem. Recently we have also seen Israeli authorities withhold residency status as a form of collective punishment.

Such was the case of Maisa, a Palestinian from the West Bank who has been living with her husband and children in Jerusalem for nearly two decades. Two years ago, Maisa's 17 year-old son allegedly stabbed a Border Police officer. The officer sustained light injuries and her son was killed by other officers at the scene. Following this incident, the Ministry of Interior informed Maisa that they were revoking her family unification request. This would mean that Maisa would no longer be able to live with her family in Jerusalem. HaMoked appealed on her behalf to the Israeli Appeals Tribunal.

Last week, the Tribunal struck down the Ministry's decision, ruling that the decision was illegal in every possible way; the Ministry of Interior, the Court ruled, has no authority to decide to deport people living lawfully in East Jerusalem simply to punish them for actions committed by family members. Such deportation, according to the Court, constitutes wrongful collective punishment.

Both on the individual level and for the broader principles involved, this is a judgement to celebrate. But this may not be the end of the story. Given the precedential implications of this case, it is likely that the state will appeal. If they do, HaMoked will continue to defend Maisa's right to live with her family in Jerusalem. Through litigation of individual cases, we hope to establish legal precedent that ends all forms of collective punishment. This has been our strategy to challenge punitive home demolitions and we will employ it to ensure residency rights as well.

מעזה ועד ירושלים, החודש האחרון היה רצוף התפתחויות מדאיגות. זכויותיהם של פלסטינים בירושלים מצויות תחת מתקפה, הן ברמה ההצהרתית, עם העברת שגרירות ארצות הברית לעיר, והן לנוכח צעדים קונקרטיים בשטח. לכן, אני שמחה לבשר שיש גם התפתחויות חיוביות.

כידוע, ישראל מקשה עד מאוד על אפשרותם של פלסטינים להתגורר בירושלים עם משפחותיהם. על אף שהזכות לחיי משפחה היא זכות בסיסית, ישראל מערימה מגוון קשיים בפני פלסטינים שרוצים לחיות בירושלים עם בן או בת הזוג. בעת האחרונה ראינו כי הרשויות הישראליות אף שוללות – כאמצעי ענישה קולקטיבית – מעמד שניתן לפלסטינים במסגרת הליכים לאיחוד משפחות.

כך היה במקרה של מיסאא, פלסטינית מהגדה המערבית המתגוררת מזה כשני עשורים עם בעלה וילדיה בירושלים. לפני כשנתיים, בנה בן ה-17 דקר, לכאורה, שוטר מג"ב. השוטר נפצע קל, והבן נהרג על-ידי כוחות הביטחון במקום. לאחר האירוע, שר הפנים הודיע למיסאא כי אשרת השהייה שניתנה לה במסגרת הליך לאיחוד משפחות תישלל. משמעות הדבר היא שמיסאא לא תוכל לחיות עם משפחתה בירושלים. המוקד עתר בשמה לבית הדין לעררים.

בשבוע שעבר, בית הדין ביטל את החלטת משרד הפנים, וקבע כי ההחלטה הינה בלתי חוקית בכל מובן אפשרי; למשרד הפנים, קבע בית הדין, אין סמכות לגרש אנשים המתגוררים בירושלים המזרחית על-פי דין במטרה להענישם על מעשים שביצעו קרובי משפחה שלהם. גירוש כזה, כך קבע בית הדין, מהווה ענישה קולקטיבית בלתי חוקית.

הן ברמה הפרטנית והן לאור העקרונות שהוא משקף, מדובר בפסק דין מעודד. ואולם, נראה כי זהו לא סוף פסוק. לנוכח הקביעות התקדימיות בפסק הדין, סביר להניח שהמדינה תערער עליו. אם אכן תעשה זאת, המוקד ימשיך להגן על זכותה של מיסאא לחיות עם משפחתה בירושלים.
