HaMoked to the IDF: What are the procedures for the transfer of complaints of violence against Palestinians held in temporary detention facilities in the Occupied Palestinian Territories?

HaMoked handles many complaints of Palestinian detainees concerning the manner by which they were detained and violence which was used against them during and after their detention. In some of the complaints which were received by HaMoked, detainees reported that when they were held in the temporary detention facilities in the Occupied Palestinian Territories (OPT) – "Etzion" and "Shomron" – they underwent interrogation concerning the detention – during which they complained of violence which was used against them.

HaMoked inquires with the IDF in this matter were transferred from one agency to another. The Military Advocate General referred HaMoked to the Detention Unit which claimed that the issue should be examined vis-a-vis the IDF Spokeperson's Unit. Eventually, on November 24, 2014, HaMoked turned to the IDF Spokeperson's Unit and requested to be advised of the identity of the officials who conducted said interrogations and what happened with the complaints of violence which were made before them. HaMoked reminded that whenever a military official encountered a situation in which violence was used by a soldier against a detainee, the official was obligated to report of same to the Military Police. Finally, HaMoked requested to receive to its possession the procedure which regulated the conduct of interrogations in detention facilities, if any such document existed.
