HCJ 1125/16 - Mer’i et al. v. Military Commander of IDF Forces in the West Bank Judgment

Judgment on HaMoked's petition against the state's intention to demolish the home in Qarawat Bani Hassan of a man suspected of involvement in a stabbing attack in the Old City of Jerusalem on October 3, 2015. The Court accepts the petition in a two judge majority, ruling the house will not be demolished. The judges rule that the decision to demolish the house is unreasonable and disproportionate, due to the family's lack of involvement in the events, and a "diminished" to non-existent affinity between the assailant, a student living in dormitories, and the home intended for demolition.
