HCJ 7987/11 - HaMoked: Center for the Defence of the Individual v. The Supervisor of the Inspector of Interrogees' Complaints, Ministry of Justice et al. Petition for Order Nisi

HaMoked's petition against the refusal by the supervisor of the Complaints Comptroller of the Israel Security Agency (CCISA) to submit to HaMoked investigation materials forming its decision to close 12 complaint files, submitted by Palestinians who underwent torture and violence during their ISA interrogations. HaMoked addressed the supervisor of the CCISA after he announced that the complaints were found unsubstantiated and the files were closed. In the petition, HaMoked emphasizes Israel's obligations under international law regarding the prohibition of torture, and the obligation to investigate any violation of the prohibition. HaMoked claims that the refusal of the supervisor of the CCISA violates the rights of the complainants to read the investigation materials on their own matter, and harms their right to due process.
