HCJ 2387/08 - Zabach et al. v. Commander of the Army Forces in the West Bank et al. Petition for Order Nisi

HaMoked's petition on behalf of four children who were born and still live in the Ramallah area, but are registered as living in Rafah in the copy of the Palestinian population registry held by Israel. The respondent refuses their request to correct the error. The petitioners claim that under the Interim Agreement, power to update the Population Registry was transferred to the Palestinian Authority and that Israel ceased updating its copy of the registry such that it no longer matches the original. The petitioners claim that updating an address is a technical matter which does not require explanation and that Israel is abusing the registry as part of its endeavor to separate the West Bank and the Gaza Strip.

On 8 December, the High Court of Justice heard a petition filed by HaMoked: Center for the Defense of the Individual on behalf of four children who were born in Ramallah and still live there, yet as a result of a registration error, they appear as residents of Gaza in Israel's copy of the population registry. Under pressure from the Court, the State admitted there was an error in the children’s registration, withdrew from its previous position, and agreed to change its records according to a notification sent by the Palestinian Authority
